A. Cancellation Policy

Introduction

Consumers are entitled to a right of cancellation under the following conditions. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly not attributable to their commercial or self-employed professional activity:

Right of Cancellation

You have the right to cancel this contract within 30 days without giving any reason.

The cancellation period is 30 days from the day you or a third party named by you, who is not the carrier, have taken possession of the last item.

To exercise your right of cancellation, you must inform us (Franziska Knöchel, Codeso Living, Lorettostr. 35, 40219 Düsseldorf, Germany, Tel.: 0211/17838894, E-Mail: info@codeso-living.de) of your decision to cancel this contract by means of a clear statement (e.g. a letter sent by post or email). You may use the attached sample cancellation form, but this is not mandatory.

You can also exercise your right of cancellation online on our website at https://www.codeso-living.de/pages/widerruf. If you use this online function, you will immediately receive confirmation of receipt with information about the content of your cancellation statement as well as the date and time it was received, on a durable medium (e.g. by email).

To meet the cancellation deadline, it is sufficient for you to send your notification regarding the exercise of the right of cancellation before the cancellation period has expired.

Consequences of Cancellation

If you cancel this contract, we will refund all payments we have received from you, including delivery costs (except for additional costs resulting from your choice of a different type of delivery than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this refund. We may withhold the refund until we have received the goods back or you have provided proof that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us or to Codeso Living, Gielenstr. 71, 41460 Neuss, Germany, without delay and in any event no later than fourteen days from the day on which you inform us of the cancellation of this contract. The deadline is met if you send the goods before the period of fourteen days has expired.

You bear the direct costs of returning the goods. The direct costs of returning goods that, due to their nature, cannot be returned to us by normal post (freight forwarding goods), are estimated at a maximum of approximately 130-150 euros per such item.

You are only liable for any diminished value of the goods if this loss in value is due to handling that was not necessary for checking the quality, characteristics, and functioning of the goods.

Exclusion or Early Expiry of the Right of Cancellation

The right of cancellation does not apply to contracts for the supply of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.

The right of cancellation expires prematurely for contracts for the supply of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.

Linked/Financed Transactions

If you finance this contract by means of a loan and later cancel it, you are also no longer bound by the loan agreement, provided that both contracts form an economic unit. This is particularly to be assumed if we are also your lender or if your lender makes use of our cooperation with regard to the financing. If the loan has already been received by us when the cancellation becomes effective or when the goods are returned, your lender will enter into our rights and obligations under the financed contract in relation to you with regard to the legal consequences of the cancellation or return. The latter does not apply if the present contract concerns the acquisition of financial instruments (e.g. securities, foreign exchange, or derivatives). If you wish to avoid a contractual commitment as far as possible, make use of your right of cancellation and also cancel the loan agreement if you are entitled to a right of cancellation for that as well.

General Notes

1) Please avoid damaging or contaminating the goods. Please return the goods in their original packaging with all accessories and all packaging components. If necessary, use protective outer packaging. If you no longer have the original packaging, please ensure adequate protection against transport damage with suitable packaging.
2) Please do not return goods to us freight collect.
3) Please note that the above points 1-2 are not a prerequisite for the effective exercise of the right of cancellation.
